How Should Cybercriminals Be Punished?

  Recently, a hacker was sentenced to 41 months in jail for illegally using hundreds of a company's computers as part of a money-making botnet. The punishment is about the same for auto theft, despite the hundreds of thousands of dollars in damages caused in addition to the thousands of dollars the scheme netted the criminal. Viruses, denial of service attacks and other malware continue to disrupt businesses and cause damages that are difficult to estimate.
  Many experts claim that the punishment for cybercrime often is out of proportion with the damages caused by the crime. Some legal experts claim that lax security on the part of Internet users is to blame, and perhaps those who practice lax security should be punished as well. Others claim that many organizations provide exorbitant estimates of true damages that cybercriminals cause and that these alleged damages provoke an emotional overreaction to the crimes.
  Keep in mind what we heard and saw in class in the video Hackers.
1. Should the government create new laws specifically aimed at punishing cybercriminals? Why or why not?
2. Should cybercriminals be punished in proportion to the alleged damages that they cause? Why or why not?
3. Who should decide the extent of the true damages caused by a cybercrime? Why?

  1. Some people thought that the hackers for computers are bad, and i think they are too. But i only think some are because if they do not do damage and they are trying to show you that you have a security problem, then i think they are good for people. But the people that go on the to steal information and crash your computers arent good.

  2. 1. I think that the government should have laws against hackers that cause some amount of damage. Hackers who break through security walls and let the person/company know what they did and how they did it, should not be punished, because they are helping you protect yourself so someone in the future can't do the same thing they did.
    2. If they hacker causes some type of damage no matter what the ammount they should be punished. I say yes, because they have to pay for the damages that they caused.
    3. I think the person or company that got hacked should be the one who decides how much damage is caused, to a reasonable extent of course.

  3. I think hackers arent doing any thing good for society. They should be tracked down and jailed for life. I mean its a crime!If hackers think theyre doing anything good from what they do than their head screws fast!

  4. I feel that the government should make new laws that are aimed at cybercriminals because they shouldn't get away with invading peoples privacy. Also, I feel that cybercrimals should be punished in proportion to the damage they have caused because it may put someone or a company in debt. Finally, i feel that a special team of tech people should decide the extent of the damages because they actually know all the ins and outs of a computer.

  5. I think they should make a a law. Most hackers are usually bad ones. There are good ones out there that tell the company that they can be hacked and don't do anything, but not enough of them to not enforce a law. Yes they should be punished on how much they've done if they stole money that would be a big time in jail. I think only hackers can decide how far they want to go in hacking the user whether its money or stealing information about them like identity theft.

  6. 1. I think that the government should start creating new laws aimed at cybercriminals because it is an ongoing problem and a complete intrusion of privacy.
    2.No they shouldn't. If all they did was break into the computer, they didn't cause any real damage. They should be punished as a burglar would be.
    3.Well the hacker will eventually be sentenced to court and at that point it would be up to the jury and the judge, but the person who was hacked should also have a say in the punishment of the hacker.

  7. yes they should because they are hacking your system. they could steal many things such as your identity and secrets. if that happens then they should be put on trial and go to prison for a long time. if they hack into your system and tell you hey i hacked into your system this is how i did it, this is how you can prevent it then they shouldnt go to jail because they were helping you. if they cause damage wen stealing something when they hack you they should pay for it. i think the victim and the judge should have a meeting about it and talk it over and then come to a conclusion about how long his sentenced should be.

  8. Yes because alot of them happen and if there is not alot of laws against it then what is there to stop them.
    Yes because there causing hundreds of thousands of dollars damge and getting of easy wich is unfare to people doing less cost affecting crimes who have it harder not saying that the other people diserve to be of easy.
    I think the people who are effected should have a say in what happens to the crimanals.

    3. The owner of the computer beacuse they no what will be taking from them along with the higher up people. the people higher up can tell what is going to come of this like jail no jail fine, etc.

  10. 1. No, the government should not create new laws because hackers aren't always a bad thing. They can show you what you can do to get better security.
    2.Yes, if the hackers cause trouble in the computer system then they should be punsihed. I think that because the hackers need to know what they've done wrong.
    3. The owner of the computer should decide extent of true damages caused by cybercrime because they know how their computer was acting and the owner can notice the glitches a lot easier.

  11. I think that they should make a new law to punish hackers, but only if the hacker did damage to the persons computer. They should determine the punishment depending on how bad the damage was, but if they are trying to help somebody, and they do no damage, then they shouldn't be punished because they did nothing wrong. The person who should decide the extent of the damage should be the people who look at any other crime, because hacking, and doing, damage, should be looked at as any other crime out there.

  12. Yes, the government should create new laws based on cybercrimes because just like when there is anything new that is happening you create new rules or laws. This is also something that is very serious that could endanger people across the world. Yes because if you break into someone's computer and cause no damage and give them a warning to get new security they should be given a fine because they did break into something they weren't supposed to. If you would steal information you should definitely could to jail for a period of time. It should be the judge and the jury just like all other crimes.

  13. i think that the hackers that hack in and say this is what i did this is how i did it and this is how to fix it should be let go or even thanked because they didnt do any harm to your site or whatever they hacked into and there more or less helping you by saying how to fix it in my own opinion i would hire them because he could hack into my site he'll know what to do better than the people i already have to protect my site. i do think though that the hackers that cause damage to your site or to your computer should be banned from the internet with no questio about it because why punish him for a certain amount of time and wait for him to do it again than just completly take that advantage from him instead.

  14. The government should make new laws for most cybercrimanals. The others are just showing the flaws in modern computers that are made today. Then the others just more money but you would have to blame the computer companys.

  15. 1. The government needs to create new laws for cybercrimes because they are taken way to lightly. A cybercriminal could crash a huge organization and lose millions of dollars for them and only get punished 2 years in jail? It should be much more.
    2.In some cases yes. If they hack in and do not cause much harm if any then they shouldnt be punished at full extent of the law. If they cause major damages they should be punished as much as possible.
    3. The government should meet with the victims to decide the damages based on how much money was lost and how hard it is going to be to recover from the damages. In this way the cybercriminal gets punishment from the government and from their victim.

  16. In my opinion cybercriminals shouldnt be punished, because they could be used in the goverment. Why I am saying this is, because if they can break into any U.S restricted file or place online, they could be used to track down terrorists or wanted person around the world, mostly because they have a much better understanding of computers. Well they should be punished if they did something wrong, but if they broke in and didnt cause any damage i dont see why they should be punish. I think who should decide how he/ she are the hackers themselves, becasue they can atleast control themselves and try not to do the same thing again.

I think that these people should get more jail time then just that because most likely once they get out they are going to do it again because they are good at it, just like any other criminal will do the same crime and get put right back in jail. Yes I think the government should make laws just for these kind of crimes, because they need to be treated as a thief but also a cybercriminal. So I think they should get alot of jail time. Yes how ever much damage they caused should be brought in the courtroom with them, and then however much they caued gets turned into jail time, and I think they should have to pay those people back the money they've stolen. I think the jury and they judge should be deciding how much time they should spend because then its fair to have both the jury and the judge be able to make a time limit.

  23. I think that the government should create new laws just for punishing cybercriminals because it will stop them from doing damage. If they made a law against it, then the cybercriminals would be more scared of getting caught and going to jail. They should also be punished in proportion to the damages they caused. I think this because if they only get charged with hacking someone’s computer, but they really stole things and deleted files, then they should have a more serious punishment. The person who should decide the extent of damages caused by a cybercrime should be a judge and give them a fair trial, just like everyone else.

  29. I think that the governmant should create new laws aimed at punishing cybercriminal's. The things the cybercriminals do are illegal,and an invasion of privacy. I do think that cybercriminal's should be punished equally to the porportion of the damges that they have caused. They can do huge damage to networks, that can cost millions of dollars to fix. I think the judge in court and the owner of the company or computer should decide the punishment. The punishment needs to be equal to the crime that was commited.

  30. I think that it is wrong for people just to go into someones computer and hack it. It takes a way thay persons privice and now that hacker will have all of thast persons personal information. I think they should be going to jail for at least a year or more if they are caughting hacking peopls personal information and taking things. if they just leve a e-mail saying i was there and didnt do anything to detroy the persons information i think that they should go to jail just for a couple of weeks if the person is caught doing it. Hacking is a horrible thing to do. people don't need there persoal informationn takin by someone that they dont no.

No, I don't think the government should make laws because there are some good things that hackers can do like show you where your program has a weakness but there are also hackers that can give you viruses and possibly steal your money. I think that cybercriminals should be punished by how much damage was caused. I think the person who has gotten hacked should have to decide how much to hold the hacker responsable for.

  32. 1. The government should make laws directly for cybercriminals, because they dont have specific laws for it yet. If they make specific laws about cybercrimes, it will be easier to convict.

    2. Yes, cybercrimes are just as bad if not worse than a regular crime. They steal money, peoples credit cards, and information. These crimes need to be dealt with.

  33. I think yes there should be laws for cybercriminals. I think there should be because sometimes what they do, is really damaging to whatever they are hacking in to. Cybercriminals should be punished in some way, since it is usually wrong to hack. Being in jail is a good punishment for it, but I think it should be a certain amount of months for how bad it is. I dont think cybercriminals should all have the exact amount of time in jail. Whoever decides the extent of punishment for other crimes, should be the same ones for hacking. Hacking should have its own law, because its considered a crime aswell. There should be a court date just like there is for any other type of crime. Cybercriminals shouldnt be let go, because nobody knows if they are going to do something again. Maybe even worse the next time.

  34. Yes i think that the government should make new laws for cyber criminals because sometimes they're taken way too lightly. They could completely crash your system and wipe out everything you have. Hackers that only check to see if you have a security problem should notify the computer's owner before doing anything so they have their consent. I think they should definitely be punished with the damage they cause and teach the cyber criminals to not do it again. The person who should determine the extent of the true damages of the cybercrime should be the owner of the company/computer because they truly know what was happening to their computer.

I would not like people invading my privacy and having the ability to invade my computer. I also think that cybercriminals should be punished in proportion to the alleged damages that they cause, because some hackers may cause more damage than others. Finally, I feel that the goverment or some federal agency with advanced computer experiance should decide the extent of the true damages caused by a cybercrime. This way, people with experiance and knowledge of what the hacker has done and the extent of the true damages caused by a cybercrime can be acknowledged.

  36. 1. Yeah, but they shouldn't punish them too much. Only punish them to a lot of years in prison if they intentionally hacked into a company. It shouldn't matter what company, either, because a company is a company, in my opinion.
    2. Like explained in number 1, yes. It shouldn't differ too much again, though, about what company was attacked, in my opinion
    3. The usual law-passers, because they are experienced with law and it's a lot of different people. However, don't put people in which computers are essential to their jobs, into the mix, because they could get too touchy, in my opinion.
    NOTE: All this cyber-crime is not needed. We should let the government have computers, and let's not be so dependent on computers, in my opinion. The Earth will still rotate, we could continue on with our lives.

  37. The government should make new laws specifically for cybercrimes. I believe the punishment should be as hard as breaking and entering crimes. If someone leaves their car unlocked it does not mean it is alright to steal it. The same goes cybercrimes even though someone does not have a security system it is not right for someone to break into their computer. But some of the fault does fall onto the owner of the computer for not having the proper security system in place. Never the less there should be very strong laws for cybercrimes or there should be a commit of people like a jury to decide the punishment for a particular cybercrime. The punishment should be the same amount of fines or jail time, for the amount damage they have caused. It should be the same amount because the punishment could prevent the person from ever doing cybercrimes again.

  39. 1. No. Unlike regular criminals, cyber-criminals are very tricky, and difficult to catch. It takes a lot of proof to prove what they are doing, and how long they've been doing it,so it would be a waste of time to make new laws about it.

    2. Yes. Because cyber-criminals are hard to catch, they get away with the crime. However if you do catch one, you need to report them right away to the police. No bad action should be left un-punished.

    3. The judge. Once a person calls the police, the police takes them to court (having the judge decide what needs to be done to the criminal depending on the crime) The judge is the one who decides if your guilty or innocent. Free to go, or do community work/jail time.

Yes, they should create new laws pertaining to cybercrimes, because those laws that do not apply in other countries such as the Philipines, and other places should be accepted as laws, and enforced everywhere. If they don't, the person that committed the crime is in no way persecuted, or seen as having committed a crime which is wrong. If someone commits a really serious crime they should be in trouble like everyone else. There should be no exceptions.Also, they should take responsibility for the crimes they have commited, and serve the time in jail or pay the appropriate price for the damages they have caused. The person for judging the price for the damages should be someone of importance. Whether it's the president of the company that has been damaged, the govenment, or a Judge in court. The decision has to be made . Personally, I think it should be the President of the company because it's his company that got damaged. He should decide what is damaged, and what needs to be fixed.

  47. I think that cybercriminals should be punished for what they do. It doesn't matter if they don't do anything, they just did it to prove that you don't have a good enough security system, they should still be punished. They're messing with someone they most likely don't know. I do think they should be punished on the damage they do. If they do something terrible the punishment should be worse. If they do something like taking your credit card number and using it to buy an extensive amount of things than they should be punished as stealing and cyberbullying so the punishment should be even worse. If they just hack into your computer and don't do anything, they should still be punished just not as bad. I think there should be a court for everyone around the world because there are people in India hacking people in America and other places like that. The person being hacked should have an input on the punishment because you know what damage was done and how bad it was. Then there should be a judge to determine the final punishment. That way everythings fair, the punishment and the victim gets their computer fixed and if there were any other issues.

But then people who hack ito your computer and do the same thing as the person who broke into your house but only the person who hackes your computer doesnt get into truble. Which makes no sense.   49. i think that people should set spicific laws on cyberterrorist because i think that people should not tack and steal basicly if your not allowed out here you should not be allowed in the computer.i do think that cyber crimanals should be punished not the death penalty but mabye like 4 years in prison sound just about right.they are bad people therefore they should go where other bad people go to JAIL.i think that the person or people that the hacker hacked and they shoulde be able to decide whaether or not to put them in jail or just leave it to be decided in court by a judge infront of a jury.

  50. 1. Yes, I think that there should be a more strict law against hackers. It is an invasion of privacy and shouldn't be allowed.
    2. I don't think that they should be punished, but they should pay a fine and go to court about it. If they crash someone's computer completely or mess something up that needs fixed, they should have to pay it.

  51. i think some hackers shouldnt go to jail as long as they dont harm anything or delete anything and leave a message telling you they hacked into your computer and didnt harm anything and think that you should get better protection on your computer. im not saying that if u break into some ones house or something and dont steal anything but you still notify they should get better locks, that still makes them need more locks or if htey break the door down they have to pay for a new door so they do harm something. in computer hacking you can just not care and re-enable your current protection since they disabled it or if you want you can buy better protection.

  53. I think that making it a law would be a big help to many companies. It can chase away hckers and protect yourself more. The people who own companies that have been hacked need to take some action also. They need to make sure that their company is safe or else people will not pay to use them. Their business will fail and many people will see how it happened. People should take notes of others mistakes.

  56. I think that the government should make hacking illegal because people have personal things on their computer, or could have things that they don't want others to see. The hackers should get a punishment when they damage other people's computers when that person takes their own money into buying the computer, If the hacker damages the computer with viruses and other things the person has to take money out of their paychecks and fix the computer. The person that has the computer decide the punishments for the hacker because it is their computer and if the hacker makes to much damage the person should sue that hacker.

  59. I think that when a hacker is caught hacking they should start with a year in jail. But if they were stealing money or creditcard numbers they should get way more jail time and have thier computer taken away from them.

  60. I think the government should make laws because it could prevent a lot more problems like identity theft, stealing money, and stealing information. Cybercriminals should be punished in proportion to the alleged damages that they cause because if someone broke into your home they would have to pay for any damage to a window or a door. If someone stole money from you on the internet they would have to pay you back and get into trouble with the police. The government or a judge should decide the extent of the true damages caused by a cybercrime because they would be trustworthy of finding the price for damages. Also the police could help out the other person and maybe not make him pay as much as the decision from the judge or government.

  62. There are many different types of hackers; however, hackers are still dangerous and can cause serious problems personally and electronically. I do believe hackers should be punished as committing a cybercrime because either way it is against the law and it may put others in dangers way. I believe every hacker should have a different amount of punishment because some do more damage than others. The amount of damage done should effect the outcome of their punishment and the time they serve for it. In my opinion, the person(s) whom were effected by the hacker should have a voiced opinion in the hackers punishment because they were violated and their personal information was exposed. Although a judge or someone with higher authority would have the final say, the victim should be able to voice their opinion.

  63. 1). Yes because sometimes cybercriminals make do damage that extents the auto crime standards. Also because the criminal may do little damage but be punished not fairly and justically.
    2). Yes because the cybercriminal should be responsible for how much damage he/she caused. Otherwise it would be unfair and they could get away with only being punished for a smaller amount of damage then what was actually commmitted.
    3). The people who should decide the actual extent of the cybercriminals doing should be the people who were affected by his/her cybercrime because only the people who were affected and the cybercriminal truly know what the extent of the damage actually was.

  64. 1. Yes I think they should create new laws for cybercriminals because they could do damage on your computer.
    2. Yes they should be punished for whatever things that they do on your computer because they could mess everything up and destroy things.
    3. The owner of the computer that got hacked should be the one to decide the punishment and the court should see if that is suitable.
